These SMS Terms (the “Terms”) govern your use of the text messaging program operated by Marble Falls Podiatrist — Frank J. Henry, DPM. By opting in to receive text messages from our practice, you agree to these Terms. Please read them carefully.

1. About the SMS Program

Marble Falls Podiatrist — Frank J. Henry, DPM operates a text messaging program for patient communication. The program is used for appointment-related communications and care coordination. We use a secure messaging platform to send and receive text messages on behalf of our practice.

2. Types of Messages You May Receive

When you opt in, you may receive text messages from our practice that include:

  • Appointment scheduling and rescheduling communications
  • Follow-up care reminders after visits

  • Responses to text messages you send to us

We do not send marketing or promotional messages through this program.

3. How to Opt In

You opt in to receive text messages by checking the SMS consent checkbox on our contact form, appointment request form, or other point of collection where SMS consent is offered. Opt-in is voluntary.

Consent is not a condition of receiving care or services from our practice. You may receive treatment, schedule appointments, and otherwise interact with our practice without opting in to text messaging.

4. About Our SMS Number

Text messages from our practice are sent through a secure messaging platform and may originate from a phone number that is different from our main office line at (830) 265-6000. This is standard for healthcare practices using automated appointment reminder and patient communication systems. The SMS-sending number is dedicated to outbound messaging and reply handling for our practice.

For voice calls and clinical questions, please continue to use our main office line at (830) 265-6000. Text messages sent to the SMS-sending number are routed to our messaging system and are not intended for clinical or emergency communication.

5. Message Frequency

Message frequency varies based on your appointment schedule, communication needs, and the nature of your care. Patients with active appointments will typically receive 2–4 messages per appointment cycle (reminder, confirmation, post-visit follow-up). Patients without scheduled appointments may receive few or no messages. We do not send routine messages to patients who have not opted in or who have opted out.

6. Message and Data Rates

Message and data rates may apply according to your mobile carrier plan. We do not charge any fees for sending or receiving text messages from our practice. Any charges that apply come from your mobile carrier.

7. How to Opt Out (STOP)

You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. After you reply STOP:

  • You will receive one final confirmation message acknowledging your opt-out
  • No further SMS messages will be sent to your number unless you choose to re-enroll
  • Your opt-out is processed automatically through your carrier; no manual action by our staff is required

8. How to Get Help (HELP)

For assistance with our text messaging program, reply HELP to any text message you receive from us. You will receive a response with information on how to contact our office for support.

9. Not for Medical Emergencies

Our SMS program is not monitored for medical emergencies. For urgent medical concerns, call our office at (830) 265-6000 during regular business hours. After hours, or if you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

Do not send clinically time-sensitive information via text message. Routine appointment-related communications are appropriate for SMS; urgent clinical concerns are not.

10. Carrier and Device Support

Our SMS program supports text messaging through major U.S. mobile carriers, including AT&T, Verizon, T-Mobile, U.S. Cellular, and other participating carriers. Carriers are not liable for delayed or undelivered messages. Standard SMS protocols apply.

11. Privacy of SMS Data

No mobile information — including phone numbers, SMS opt-in data, and messaging consent — will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services (such as customer support, message delivery infrastructure, and appointment reminder platforms) is permitted only under confidentiality agreements that prohibit further use or disclosure for marketing purposes. All categories of information collected for text messaging purposes exclude sharing with third parties for marketing. Text messaging originator opt-in data and consent will not be shared with any third parties under any circumstances.

12. Eligibility

You must be at least 18 years old, or the parent or legal guardian of a minor patient, to opt in to our SMS program. By opting in, you confirm that you are the authorized account holder for the mobile phone number provided, or that you have permission from the account holder to enroll the number in our messaging program.

13. Changes to These SMS Terms

We may update these SMS Terms from time to time. When we do, we will revise the Effective Date at the top of this page. Continued participation in our SMS program after changes are posted constitutes acceptance of the updated Terms.

If we make material changes that significantly affect your rights or how the program operates, we will provide additional notice where reasonably possible.
